What are Compensable Death Benefits?

Under North Carolina law, if an employee dies as a result of a work-related accident or injury or dies as a result of an occupational disease, his or her family may be eligible to receive up to 400 weeks of workers’ compensation benefits. A minor child or disabled spouse may be entitled to receive benefits beyond the 400-week time period, depending on the facts of the particular worker’s compensation case.

The family may also qualify for up to $3,500.00 for actual funeral expenses. In addition if medical expenses were incurred prior to death from injuries sustained on the job, the workers’ compensation insurance carrier may also responsible for these expenses.
